This is the Privacy Policy of the PayrollPro.PH website (the "Site"), operated by Analytcis and Data Integrity, Inc. (also known as ADIConsulting.PH) and our related products and services. It describes the information that we collect from you as part of the normal operation of our Site, and how we use and disclose this information.
By accepting the Privacy Policy in registration or by visiting and using the Site, you expressly consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms of Service.
In this Privacy Policy, we use the following terms to describe different types of visitors to our Site. Our Subscribers are called "Clients" and our Subscribers’ users are called "Employees". We use the word "Company Admin" to describe persons to whom Subscribers give "administrator" access on the Site. Together with registered users of our forum or other interactive areas of the Site, these people are collectively described in this Privacy Policy as "Users" of our Site.
How We Use Your Information
We use personal information in the file we maintain about you, and other information we obtain from your company including current and past data and your site activities, to provide to you the services offered by the Site; troubleshoot problems; resolve service and process disputes; bill any amounts due from your company; measure consumer interest in our products and services, inform you about online and offline offers, products, services, events and updates; deliver information to you that, in some cases, is relevant to your interests, such as product news; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our Terms of Service; provide you with system or administrative messages, and as otherwise described to you at the time of collection. On occasion we use email address or other contact information to contact our Users to ask them for their input on our services, to forward to them media opportunities, and even to invite them to dinner.
We may also use personal information about you to improve our marketing and promotional efforts, to analyze Site usage, to improve our content and product offerings, and to customize the Site's content, layout, and services. These uses improve the Site and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using the Site.
If you wish to subscribe to our newsletters, we will use your name and email address to send the newsletter to you. Out of respect for your privacy, we provide you a way to unsubscribe in the email. What Information Do We Collect?
Our primary purpose in collecting personal information from you is to provide you with a safe, smooth, efficient, and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only collect personal information about you that we consider necessary for achieving this purpose.
In general, you can browse the Site without telling us who you are or revealing any personal information about yourself. Once you become a User, we require you to provide various contact and identity information, billing information, and other personal information as indicated on the relevant forms on the Site (which vary, depending on what kind of User you are), and you are no longer anonymous to us. Where possible, on these forms we indicate which fields are required and which fields are optional.
In addition, as you use the Site, you can from time to time enter or send to us personal information. For example, if you are a Subscriber, you can enter your time tracking and other billing information, and if you are a Employee you can enter information about your attendance, required government info, within a Subscriber's organization. As you use the Site you can also from time to time enter personal information about third parties. For example, if you are a Subscriber, you can enter personal information about your Employees or your Users.
You always have the option to not provide information by choosing not to become a User or by not using the particular feature of the Site for which the information is being collected.
We also automatically track certain information about you based upon your behaviour on our Site. We use this information to do internal research on our users' demographics, interests, and behaviour to better understand, protect and serve you and our community. This information may include the URL that you just came from (whether this URL is on our Site or not), which URL you next go to (whether this URL is on our Site or not), your computer browser information, and your IP address.
"Cookies" are small files placed on your hard drive that assist us in providing our services. We use cookies to allow you to enter your password less frequently during a session, and we use data collection devices (such as Google Analytics), including cookies, on certain pages of the Site to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety, to offer certain features that are only available through the use of a cookie and to allow us to provide information that is targeted to your interests. Our Disclosure of Your Information
We will share your personal information with third parties only in the ways that are described in this privacy statement. We do not sell your personal information to third parties. The following describes some of the ways that your information may be disclosed in the normal scope of business to provide our services:
Subscribers and Users, Etc. In the normal operation of the Site Subscriber timesheets (including information entered by "staff" members) are disclosed to the applicable User, and User information is disclosed to the applicable Subscriber. In general, information you enter on the Site is available to the other persons – whether they are registered Users, Subscribers, or Company Administrator – to whom you give access to your account or to whom you give access to the information through the normal operation of the Site.
Payment Information. We use credit card and other payment information (such as PayPal email addresses) you submit to us on the Site to process payments you make through the Site. We do not store credit card or other payment method information, Credit card information is sent in an encrypted fashion to credit card processors that adhere to industry standard PCI compliant procedures to encrypt, secure and store credit card information. Payment processors (like PayPal and Stripe) have the sole and complete responsibility for the storage of credit card and payment information.
Anonymized Aggregated Data. We aggregate and anonymize attendance information including (but not limited to) industry type, number of members, average number of hours worked, hourly rates and methods of punching in and out, and disclose such information in a non-personally identifiable manner to Subscribers. However, in these situations, we do not disclose any information that could be used to identify you personally.
Forum. If you post on our forum or blog your username and other information you include is displayed in your postings or comments, and is therefore available to the public. All of your activities in the public areas of the forum will be identifiable to your User ID, and other people can see your published content.
Subsidiaries and Affiliates; Service Providers. We may from time to time use the services of affiliates, subsidiaries and unrelated service providers in the operation of the Site, and may disclose personal information to them in the course of our use of their services. For example, we may use the services of third-party hosting companies to host the operation of the Site. This may involve the hosting of data, including personal information, on servers operated by those hosting companies. We take care to use only service providers that we believe are reputable and able to live up to our and your expectations, including about the handling of confidential information.
Legal Requests; Emergencies. PayrollPro.PH may disclose your personal information (a) to any governmental authority as part of an investigation to determine our compliance with any applicable law, rule, or regulation (including privacy laws, rules, and regulations), (b) in response to a court order, subpoena, discovery request, or other lawful judicial or administrative proceeding, (c) as otherwise required under any applicable law, rule, or regulation, and (d) in good faith, to protect or defend the rights or property of PayrollPro.PH and other users.
Your Use of Other Persons’ Information
In order to facilitate the services provided by the Site, the Site allows you in certain circumstances to give other Users limited access to the personal information of other persons. For example, if you are a Subscriber, you may use the Site to give access to a staff member to the personal information of your Members. By entering into our Terms of Service, you agree that, with respect to the personal information of other persons that you collect, use and disclose on the Site, you have all necessary consents and rights to collect, use and disclose that information as described in this Privacy Policy from time to time, and you agree that the indemnity you give to us in the Terms of Service applies to any non-compliance by you with the foregoing.
If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. PayrollPro.PH stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact us at support@payrollpro.ph to request that we remove this information from our database.
Security
PayrollPro.PH strives to protect your personal information. For security of transactions, we use the Secure Sockets Layer (SSL) protocol, which encrypts any information, such as credit card number and billing information, you send to us electronically. The encryption process protects your information, by scrambling it before it is sent to us from your computer. Once PayrollPro.PH receives your transmission, we make commercially reasonable efforts to ensure its security on our system. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot warrant the security of any information you transmit to us. International Data Transfers.
We are accessible globally. Personal Data may be stored and processed in any country where we have our servers or where we engage service providers. We may transfer Personal Data that we maintain about you to recipients in countries other than the country in which the Personal Data was originally collected, including served territory like United States, Australia, and Europe. Those countries may have data protection rules that are different from Philippines. However, we will take measures to ensure that any such transfers comply with applicable data protection laws and that your Personal Data remains protected to the standards described in this Privacy Policy. Your Rights and Choices.
You have choices regarding our use and disclosure of your Personal Data:
a. Opting out of receiving electronic communications from us. If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our Services.
b. How you can see or change your account Personal Data. If You would like to review, correct, or update Personal Data that You have previously disclosed to us, You may do so by signing in to your by contacting your employer.
c. Your data protection rights. Depending on your location and subject to applicable law, you may have the following rights with regard to the Personal Data we control about you:
The right to request confirmation of whether PayrollPro.PH processes Personal Data relating to you, and if so, to request a copy of that Personal Data;
The right to request that PayrollPro.PH rectifies or updates your Personal Data that is inaccurate, incomplete or outdated;
The right to request that PayrollPro.PH erase your Personal Data in certain circumstances provided by law;
The right to request that PayrollPro.PH restrict the use of your Personal Data in certain circumstances, such as while PayrollPro.PH considers another request that you have submitted (including a request that PayrollPro.PH make an update to your Personal Data); and
The right to request that we export to another company, where technically feasible, your Personal Data that we hold in order to provide Services to you.
Where the processing of your Personal Data is based on your previously given consent, you have the right to withdraw your consent at any time. You may also have the right to object to the processing of your Personal Data on grounds relating to your particular situation.
d. Process for exercising data protection rights. In order to exercise your data protection rights, you may contact PayrollPro.PH as described in the Contact Us section below. We take each request seriously. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your Personal Data. If you feel that you have not received a satisfactory response from us, you may consult with the data protection authority in your country.
For your protection, we may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. If we no longer need to process Personal Data about you in order to provide our Services or our Sites, we will not maintain, acquire or process additional information in order to identify you for the purpose of responding to your request.
If you are a Member of a PayrollPro.PH subscriber, please direct your requests directly to the Company. For example, if you are making, or have made, a purchase from a merchant using PayrollPro.PH as a payment processor, and you have a request that is related to the payment information that you provided as part of the purchase transaction, then you should address your request directly to the merchant.

Account Deletion
PayrollPro.PH is a complex business network tools that connects many of users. PayrollPro.PH manages a business eco system that brings together employees, companies and customers. This network relies on the exchange and sharing of information that is important to others in your network. Tracked hours, attendance status, employees, departments are all vital to other people that work with you. These are the official history of work done and moneys paid.
The complexity and connected nature of the system requires that this history exists in perpetuity to accommodate proper function and accounting for the other systems that you have connected to like payroll and accounting systems. PayrollPro.PH cannot guarantee the deletion of all your information.
When a customer chooses to close an account we will remove your information from our marketing and billing systems. This will ensure that there are not further mailings or billings directed towards the canceled user.
As we continue to refine PayrollPro.PH we will establish a method for the complete removal of all user information from the system without breaking accepted accounting principles for other connected PayrollPro accounts. This document will evolve as these new methods are defined and tested for permanent account deletion. Users wishing to be notified when this development is complete can indicate their wishes via support@payrollpro.ph.
Data portability (to have data provided in a portable form to the individual requesting it or to have data sent to a third party at an individual’s request).
While PayrollPro.PH is a data-processor for members of organizations that use our platform, PayrollPro.PH is a data controller of all its organizations’ personal data. PayrollPro.PH sets out what organizations data it holds, how it protects organizations data, why it holds organization data and what it does with organization data in this privacy policy.
Notification of Privacy Statement Changes
We may update this privacy statement to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective. By accessing and using PayrollPro.PH online app, mobile app, functions, including https://payrollpro.ph/ ("Website") and other services of Analytics and Data Integrity, Inc. (“Company”), you agree, without restriction, to be bound by the terms and conditions contained in this Terms of Service Agreement (“Agreement”). Please read the Agreement carefully. If you do not agree with the Agreement, you should not access, use, or download materials from the Company’s Website and Services.
The Company reserves its right to update or modify this Agreement at any time and without prior notice. Your use of the Website and Services following any change constitutes your agreement to follow and be bound by the Agreement as revised. For this reason, the Company encourages you to review the Agreement each time you access the Website and use the Services.
Use of the Company’s Website and Services
You must strictly follow and comply with the Agreement and other policies that the Company may have given you in relation to your access with the Website and use of the Services.
You may only use the Company’s Website and Services when permitted by the Company’s policies.
The Company has the sole discretion to suspend or terminate the Services being provided to you, if you do not comply with the Agreement and the Company’s policies, or if the Company is investigating suspected misconduct in the usage of its Services.

User Content of the Subscriber and its employee, in relation to these services (such as timekeeping, payroll, reports, HR services) are subscriber’s property. PayrollPro.PH’ only right to that User Content is limited as granted under these Terms of Agreement.
Other than the User Content, the Services, all Content and all software available on the Services or used to create and operate the Services is the property of Analytics and Data Integrity, Inc. or its licensors. All trademarks, registered trademarks, product names and company names or logos mentioned in the Services are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by PayrollPro.PH.
Your User Content is your responsibility. We have no responsibility or liability for it, or for any loss or damage your User Content may cause to you or other people. Though we do not claim any ownership interest in your User Content, but we do need the right to use your User Content to the extent necessary to operate the Site and provide the Services, now and in the future.
Privacy and Information Protection
The Company will take appropriate measures to protect your privacy as you use the Website and Services. The Company’s Privacy Policy sets forth its approach with respect to the Information that are collected from the visitors of the Website and users of the Services. By using the Website and Services, you also agree to be legally bound by the Company’s Privacy Policy.
Personal Information Processing Consent
By using our Website, our Products and Services, you agree and consent that the Company may collect, use, retain, disclose and process personal information set out in the enrollment form and/or otherwise provided by you, your company or possessed by the Company for one or more of the purposes stated below:

You agree that you are responsible for obtaining direct consent from your employees and referrals before using our Website and Services.
Your personal information may be disclosed by the Company to its third party service providers for one or more of the purposes stated above, as such third party service providers, if engaged by the Company, will be processing your personal information on behalf of the Company.
You also have the right to request for your personal information to be corrected or removed should you find that your information is incorrect, incomplete or irrelevant.
Opt-Out or Correction of Data
You have the right to opt out of receiving product announcements. Kindly click the unsubscribe button on the email, notify the Company through SMS, or send a message to the email address below to exercise your right to opt out. Please note that if you do not exercise your right to opt out of receiving such product announcements or other marketing messages, you will be deemed to have consented; therefore, we will continue to send product announcements to you.
Your PayrollPro.PH Account
Some of the functions of the Website and Services may require the creation of an account with the Company. As part of the registration process, you will select a Username and Password, and provide Information, which must be accurate and updated. You may not select or use a Username of another person with the intent of impersonating him or use a Username of which another person has rights without such person’s authorization.
You agree to take reasonable measures to protect the security of the Password that you use to access the Website and Services and agree not to disclose the same to third parties. You are responsible for any activity in your account, whether or not you authorized the same. You shall immediately notify the Company of any known or suspected unauthorized use of your account, or any known suspected breach of security, including loss, theft, or unauthorized disclosure of your password or any other relevant registration details provided.
Failure to comply with the above shall constitute a breach of this Agreement, which may result in the immediate termination of your account.
Content You Provide
The Website and Services provide features that allow you to upload, store, and share your Files with certain individuals within your organization. You are responsible for maintaining and protecting all of your Files. You acknowledge your responsibility to provide accurate information including personal and sensitive personal information of your employees and referrals. The Company will not be liable for any loss or corruption of your Files, for any costs or expenses associated with backing-up or restoring any of them, or for any incorrect information that you provide to our Website. You acknowledge that it is your responsibility to use a secured encrypted connection to communicate with the Website and Services when transmitting your Files to the Company. You shall immediately notify the Company of any unauthorized use of your account, or any known suspected breach of security.

Website and Service Modification
The Company is constantly changing and improving its Website and Services. As a result, it may be necessary that the Company add or remove certain functionalities or features in the Website and Services.
The Company acknowledges that you are the owner of the Information and Files that you input and transmit using the Website and Services. Moreover, the Company acknowledges the importance of preserving and accessing those Information and Files. Hence, if the Company discontinues a service, it will, whenever practically possible, send an advance notice and give you a reasonable opportunity to get all your Information and Files out of that service.
Integration with Other Sites
This Agreement applies only to PayrollPro.PH Website and Services. PayrollPro.PH may frame, contain reference, access links, or APIs, with other websites like Facebook, Google, Microsoft, Apple, other HR platforms which have their own Terms of Services and Privacy Policy. These integrations and/or access links are continuously developing to provide convenience, accessibility, smoother UI/UX, and better system performance. PayrollPro.PH do not imply any review or endorsement of the material on these websites or any association with their operators. The Company cannot and does not guarantee or verify the contents of said websites, which may contain information that is inaccurate, incomplete, or outdated. Your access and use of such websites (and the websites to which they are linked to) is solely at your own risk. The Company cannot be held liable for any damages or implications caused by visiting any external links mentioned.
Social Media Features
The Website and Services uses Social Media Features and widgets (e.g. “Facebook Messenger, Like Button, Share Button”), and other interactive mini-programs and special sharing buttons, which may help share web content directly from web pages to some social media platform. These features may collect your Internet Protocol address and the website pages you are visiting. These features may also set a cookie to enable them to function properly. Your interactions with these features are governed by the privacy policy and other policies of the third party providing them. You are advised that the usage of these features is solely at your own discretion and at your own risk. The Company cannot be held liable for any damages or implications caused by using these features.
Public Information
The Website may provide opportunities for you to post questions and information, or provide feedback and comments regarding the Company’s products and services.
Although the Company may, from time to time, monitor or review the information posted in the Website, the Company is under no obligation to do so, and assumes no responsibility or liability arising from the content of the Website in general or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in the same.
You are also prohibited from posting or transmitting any unlawful, libelous, defamatory, threatening, obscene, pornographic, or profane materials or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate the law. The Company will fully cooperate with any law enforcement authorities or comply with any court order requesting or directing the Company to disclose the identity of anyone posting such material.
Warranties
The Content, Add-ons and Services are provided to you on an "as is" basis without warranties from PayrollPro.PH of any kind, either express or implied. The Company does not make warranties of any kind regarding the Website and their contents. There may be delays, omissions, or inaccuracies in the Website and Services and their contents. The Company does not warrant the accuracy, completeness, timeliness, title, or fitness of a particular purpose of the Website and Services and their contents, and the Company hereby disclaims any such express or implied warranties. The Company does not also represent or warrant that the Website and Services are free from viruses, malware, or other codes that have contaminating or destroying properties.
Providing a Reliable and Secure Service
If you have spent any time reviewing the Services, you will hopefully have noticed that we take reliability and security seriously. We put a great deal of effort into ensuring that our service operates all the time, and that it is a secure environment for your data. We use what we believe to be "best-of-class" hosting services and security technologies and services that we believe provide you with a secure and safe environment.
However, no system is perfectly secure or reliable, the Internet is an inherently insecure medium, and the reliability of hosting services, Internet intermediaries, your Internet service provider, and other service providers cannot be assured. When you use PayrollPro.PH, you accept these risks, and the responsibility for choosing to use a technology that does not provide perfect security or reliability. In particular, Subscribers who enable auto-billing and choose to store their credit card information accept these risks to the security of that credit card information. When storing credit card information using the PayrollPro.PH recurring billing module Subscribers acknowledge that they are aware of, and accept as satisfactory, PayrollPro.PH's credit card protection procedures. Ultimately, credit card data is provided by Subscribers, and they are responsible for its protection.
PayrollPro.PH provides technological to facilitate the use of our services. If any third party is authorized through your PayrollPro.PH account ( either by you or your Company) to have access to your User Content through our platform, we cannot control and are not responsible or liable for the third party’s use of your User Content.
Advertisements and Promotions
PayrollPro.PH may run advertisements and promotions for third parties’ services. Your business dealings or correspondence with, or participation in promotions of, advertisers other than PayrollPro.PH, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. PayrollPro.PH is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third-party advertisers on the Services.
Limitation of Liability
The use of the Website and Services is at your sole risk. Under no circumstance shall the Company or any of its directors, officers, employees, or agents be held liable for any direct or indirect losses or damages arising out of, or in connection with, your use of or inability to use the functionalities of our Website and Services.
Moreover, the Company shall not be responsible for your non-compliance with the labor code, rules and regulations relating to employment, and other pertinent laws, rules and regulations of the Philippines that you are required to comply with.
This Limitation of Liability applies to all losses and damages of any kind whatsoever, whether direct or indirect, general, special, consequential, exemplary, incidental or otherwise, including, but not limited to, loss of profits, revenues, information, files, documents, or data. This Limitation of Liability applies whether the alleged liability is based on contract, negligence, tort, or any other basis and even if an authorized representative of the Company has been advised of or should have known the possibility of such damages. If any part of this Limitation of Liability is found to be invalid or unenforceable for any reason, the aggregate liability of the Company under such circumstances shall not exceed the amount you paid to the Company to use the Services.
Subscriber’s Inactive Accounts; Termination of Agreement
If your account is inactive for at least three months, we may deactivate your account. Deactivated accounts are not deleted – they are placed in storage and can be restored. We will notify you by email if we decide to deactivate your account. If you know in advance that your account will be inactive at some time and don’t want us to deactivate it, let us know in advance at info@payrollpro.ph . If after your account has been deactivated it stays inactive and we don’t hear from you, we may terminate it at any time and without notice.
Your PayrollPro.PH access maybe terminated services including your agreement to these Terms at any time. If you terminate your use of the Services you must pay the fees applicable for the balance up to current billing period, including for any Add-ons you may be using. When your PayrollPro.PH account is terminated, your User Content will, shortly thereafter, not appear on the Services, except for User Content submitted to public areas of the Site such as the blog, forum, or product reviews, which may remain on the Site after termination. We may also retain an archival copy of your User Content after termination.
About the Agreement
This Agreement constitutes the entire agreement between you and the Company with respect to your access to and/or use of the Website and Services. Please note, however, that this Agreement is not intended to replace or modify those contained in your written agreement with the Company, if any. In case of an inconsistency, the terms and conditions of your written agreement will prevail over those contained herein.
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
The failure by the Company to exercise or enforce any right or provision under this Agreement shall not constitute a waiver of such right or provision. All rights not expressly granted herein are hereby reserved.
